LEGAL TERMS AND CONDITIONS OF THE PROMOTION

L’EMBLEME: 1 OF 1 + ORIGINAL ARTWORK

The promotion is organized by Javier Garafulla Llopis, with NIF 73441871L, owner and person responsible for the activity conducted under the brand L’EMBLEME (hereinafter, “L’EMBLEME” or the “Organizer”), with legal address at Calle Santa Engracia 163 2º derecha, 28003, and through the website notreembleme.com.

L’EMBLEME organizes this promotional action under the modality of a random combination for advertising or promotional purposes, in accordance with the applicable Spanish regulations.

The purpose of the promotion is to celebrate the end of L’EMBLEME’s summer season and to promote the brand and its products to the public.

1. NATURE OF THE PROMOTION

Participation in the promotion is linked to the purchase of a customized brand sticker, sold by L’EMBLEME at its regular price of 2 euros, with ONE (1) entry per unit purchased, with no surcharges, additional fees, or amounts specifically intended to purchase an entry into the draw.

The purchase of the product retains its nature as an independent sale at all times.

Participation in the promotion constitutes exclusively an incidental promotional benefit associated with said purchase and does not imply the payment of any additional amount by the customer.

2. TERRITORIAL SCOPE

The promotion will be valid exclusively for residents of Spain.

The prize will only be shipped to a valid address located within Spanish territory.

3. TEMPORAL SCOPE

The valid participation period will begin on:

August 23, 2026, at 7:00 PM

and will end on:

August 24, 2026, at 7:00 PM, Spanish peninsular time.

Purchases made before or after this period will not generate the right to participate in the promotion.

4. REQUIREMENTS TO PARTICIPATE

All natural persons who meet the following criteria may participate:

• Are over 18 years of age.
• Reside legally in Spain.
• Make a valid purchase of the promoted product during the established period.
• Provide truthful identification and contact information.
• Expressly accept these Legal Terms and Conditions.

Employees of the Organizer and those who have directly participated in the technical organization of the promotion may not participate.

5. PARTICIPATION MECHANICS

For each valid unit of the promoted product purchased during the validity period, the customer will receive ONE (1) entry in this promotion at no additional cost.

Each entry will be assigned a unique sequential number, assigned in chronological order of purchase and linked to the corresponding order number generated by L’EMBLEME.

The same person may have multiple entries if they have purchased multiple valid units of the promoted product.

Operations that are canceled, fraudulent, unpaid, or fully refunded before the draw takes place will not be considered valid entries.

L’EMBLEME may exclude any entry for which there are reasonable indications of tampering, fraud, use of false identities, or violation of these Terms and Conditions.

6. PRIZE

There will be ONLY ONE WINNER.

The prize will consist of the following two pieces together:

1. L’EMBLEME T-SHIRT: 1 OF 1

An exclusive t-shirt developed by L’EMBLEME for this campaign, produced as a unique piece.

There is no second identical unit intended for sale.

2. ORIGINAL ARTWORK: 1 OF 1

An original painting created specifically for this promotional action and conceived as a complementary piece to the t-shirt.

Features:

• Original and unique work.
• Approximate dimensions: 100 × 140 cm.
• Technique: acrylic on canvas.
• Artist: Cristina Postigo.
• Piece created specifically for L’EMBLEME and for this promotion.

Both pieces form a single, indivisible prize.

The total market value attributed to the prize is:

€500

The prize cannot be exchanged for cash, store credit, or any other product.

7. SELECTION OF THE WINNER

Once the participation period has closed, L’EMBLEME will prepare the final list of valid entries.

Each entry will be assigned a unique identifier.

The winner will be selected using a random computer selection procedure that ensures that all valid entries have the same chance of being selected.

In addition to the main winner, three (3) substitute participants may be selected in order.

L’EMBLEME will retain sufficient evidence of the selection process in order to be able to prove the correct conduct of the draw.

The draw will take place on:

August 24, 2026, from 8:00 PM

8. COMMUNICATION TO THE WINNER

L’EMBLEME will contact the winner using the details provided during the purchase.

The winner will have a maximum period of 48 hours from the first communication to respond and provide the information necessary to verify their identity and manage the delivery of the prize.

L’EMBLEME may request a document verifying identity exclusively for the purpose of checking compliance with participation requirements.

If the winner:

• does not respond within the established period;
• expressly waives the prize;
• cannot prove their identity;
• fails to meet the requirements of these Terms and Conditions; or
• has participated fraudulently,

they will lose their status as winner, and the prize will be offered to the first substitute, applying the same procedure successively.

9. PRIZE DELIVERY

The prize will be sent by L’EMBLEME to the address provided by the winner within the territory established in these Terms and Conditions.

L’EMBLEME will cover the corresponding shipping costs.

Due to the dimensions, characteristics, and artistic nature of the prize, shipping may be carried out through a special logistics service and in one or more packages.

The Organizer will coordinate directly with the winner on the necessary conditions to carry out the delivery.

10. TAXATION

The promotion will be subject to Spanish tax regulations applicable to random combinations for advertising or promotional purposes.

L’EMBLEME will assume the tax obligations that legally correspond to the Organizer derived from the realization of the promotion.

Likewise, the prize may be considered a capital gain for the winner in accordance with the regulations of the Personal Income Tax (IRPF).

When it is legally required to withhold or make an account deposit associated with the prize in kind, L’EMBLEME will perform the corresponding tax actions and provide the winner with the relevant supporting documentation.

The winner will be responsible for complying with any personal tax obligations that may arise from receiving the prize.

11. DATA PROTECTION

The participants' personal data will be processed by Javier Garafulla Llopis, as the data controller, for the purpose of:

• managing participation in the promotion;
• checking compliance with these Terms and Conditions;
• selecting and contacting the winner;
• managing the delivery of the prize; and
• complying with the corresponding legal and tax obligations.

Data will not be used to send commercial communications when there is no independent legal basis that allows for such processing.

12. PUBLICATION OF THE WINNER

L’EMBLEME may publicly communicate that the promotion has concluded and that a winner exists.

Without additional authorization from the winner, the information published will be limited to the data strictly necessary to prove the result of the promotion, avoiding the publication of unnecessary personal information.

The use of photographs, videos, full name, image, or content of the winner for advertising purposes will require, when necessary, the corresponding authorization.

13. FRAUD AND IRREGULAR ENTRIES

L’EMBLEME reserves the right to exclude any entry where there are reasonable indications of fraud, manipulation of the system, misuse of automated mechanisms, false data, fraudulent payment operations, or any action contrary to good faith.

The exclusion must be based on objective reasons related to the proper development of the promotion.

14. MODIFICATION OR CANCELLATION

L’EMBLEME may modify, suspend, or cancel the promotion in the event of extraordinary circumstances, force majeure, widespread fraud, serious technical errors, or circumstances beyond its control that make its normal development impossible.

Any relevant modification will be communicated to the participants through the same channels used to initially communicate the promotion.

Modifications will not unfairly prejudice the rights acquired by the participants.

15. LIABILITY

L’EMBLEME will not be liable for errors derived from incorrect information provided by the participant or for incidents attributable to third parties that are outside its reasonable control.

The Organizer will take the reasonably necessary measures to ensure the preservation and correct delivery of the two pieces that make up the prize.

16. SHOPIFY, INSTAGRAM, META, AND OTHER PLATFORMS

The promotion is organized exclusively by L’EMBLEME.

Shopify, Instagram, Meta, Facebook, TikTok, YouTube, and any other platform used to communicate or manage the promotion do not sponsor, administer, or are associated with it, unless expressly stated otherwise.

Participants exonerate these platforms from any liability related to the organization of the promotion, within the limits legally permitted.

17. ACCEPTANCE OF TERMS AND CONDITIONS

Participation in this promotion implies full acceptance of these Legal Terms and Conditions.

18. APPLICABLE LAW

This promotion will be governed by Spanish law.

Any dispute will be submitted to the courts and tribunals that are competent in accordance with the current legislation on consumers and users, without these Terms and Conditions being able to limit the mandatory rights recognized to consumers.
